Christmas Party and Election

DECEMBER 18, 2009 AT 5:00 pm

The Bar Christmas Party & Election will be held at the Bushwacker in the back room again this year. The party is scheduled for 5:00 pm – 7:00 pm. The election will be for TWO presidents! President 2010 and president-elect for 2011. Be there or be elected.

As prior presidents have done for me, I will do what I can to assist in the transition. The transition will occur. The first bar lunch of 2010 won’t be until January 15th so there will be plenty of time to figure it out.

CLALLAM LEGAL II: Thank you!

Cliff, Selinda and I extend thanks and appreciation to those who helped with Clallam Legal this year and those who attended! Pro Bono received a great boost for its budget and we really had a great program this year.

Next year, remember that this is the largest fund raiser for Pro Bono. We will be working throughout the year on our next program. Do not hesitate to suggest speakers for next year.

Bar Lunch 12/4/09

Dear Members:

NEW LUNCH LOCATION (testing, testing…):

I have arranged for the Bar to have lunch on December 4th at the Bushwacker. The  Bushwacker has opened for lunch and expressed a willingness to have us for lunch. We need to continue to confirm attendance to the extent we can for the Bushwacker. The meeting would be in the back room however they may not be able to close the room off if there are less than 20-25 people. We should hear from them on that issue before the 4th meeting. They DO have a regular menu and we would be able to order off the menu individually!

At the 12/4 luncheon, the one big agenda item will be to discuss and determine luncheon location for the next while. Please confirm your intent to attend the next bar lunch no later than 12/2.

Beware: Attorney scam

November 5, 2009

To all practitioners: please take notice of a current email scam running rampant across the country, including Washington. The scam asks for your help in collecting a judgment. They offer you a very large percentage for doing very little work, by accepting payment on the judgment into your trust account, and then the scammers pressure attorneys into disbursing their agreed share of the funds before they are actually collected by the bank.

At least one attorney in Washington, apparently, has fallen victim to this, and is now looking at repaying the bank hundreds of thousands of dollars, and having a discussion with the bar association. Below is a sample email request by the scammers.

Always be very wary of any email from anyone you do not know. Never click on links in an email. If you are very certain of the source of the email, the best policy is to cut and paste links into your browser. Replying to potential scammers or spammers is only likely to increase your exposure.

SAMPLE SCAM:

Dear Counsel.

My name is Linda Cheng. I am a contacting your firm in regards to a divorce settlement with my ex husband(Randy L. Cheng) who resides in your jurisdiction. I am currently on assignment in Japan. We had an out of court agreement for him to pay $350,450.00 plus legal fees. He has only paid me $50,000 since .I am hereby seeking your firm to represent me in collecting the balance from him. He has agreed already to pay me the balance but it is my belief that a Law firm like yours is needed to help me collect payment from my ex-husband or litigate this matter if he fails to pay as promised.

UPDATE
The WSBA has also sent out an email confirming this problem. Please take great care with any unsolicited email. Also, I got a call from a lawyer in Colorado who had nearly been victimized by the same “Linda Cheng.” -Mark Baumann

1. Mary Brewer is available as an Adoption Guardian at Litem. If you would like her contact information, please let me know or contact the court administrator.

2. Our local Northwest Justice Project office has a staff attorney position open. I am confident Steve Robins would be happy to answer any questions you may have about the position or provide contact information for interested applicants.

3. Commissioner Basden asked that the following information be forwarded:

I have looked carefully at the statues regarding pre and post placement reports in adoptions. For clarification, when a pre placement report is required, proof of the necessary background checks (i.e. fingerprint check with the FBI) will need to be filed with the Court.
Second, even in situations where a step parent is adopting the child, a post placement report needs to be filed. These should be fairly strait-forward, particularly when the parent and step parent have been married for quite a while. However, I think that the statute requires the report regardless of the length of the relationship.
If anyone has general questions, please contact me for clarification.
